Terms of Service

What you can expect from us, and what we need from you.

1. These terms

These terms apply when you use this website and when you engage AM Builder to build or run an automation system. If we sign a separate written agreement, proposal, or statement of work with you, that document governs wherever it differs from these terms.

2. Using this website

You may read the site, download what we offer, and contact us. You may not scrape it, copy it wholesale, attempt to break into it, or use it to send us anything unlawful. The content, copy, design, and code on this site belong to AM Builder.

3. What we do

We design, build, host, and maintain automation systems — including AI phone answering, lead follow-up, appointment reminders, review requests, invoicing and payment chasing, and customer reactivation campaigns. What you specifically get is defined in your quote or proposal, not on this page.

4. Quotes, scope, and changes

Quotes are based on the scope we discussed and are valid for 30 days unless we say otherwise. If the scope changes after work starts, we will tell you what it changes about the price and timeline before we do the extra work. Timelines we give are good-faith estimates and depend on how quickly we get what we need from you.

5. Fees and payment

  • Setup fees, project fees, and any performance-based fee are set out in your quote.
  • Monthly plans are billed in advance and cover hosting, monitoring, and support.
  • Invoices are due on the terms stated on the invoice. If an invoice goes unpaid, we may pause your system until it is settled.
  • Prices on this site are in Canadian dollars and do not include applicable taxes.
  • Third-party costs passed through to you — telephone numbers, message fees, API usage — are yours, and we will tell you about them in advance.

6. Cancellation

There is no lock-in contract on monthly plans. You can cancel at any time and service continues to the end of the period you have paid for. Setup fees and work already performed are not refundable. If you cancel, we will pause the system rather than destroy it, so you can restart later.

7. What we need from you

  • Accurate information, and reasonably prompt answers when we need a decision.
  • Access to the accounts and tools your system needs to connect to.
  • The legal right to the customer data you give us, and valid consent to contact the people on it — see our Messaging Terms and Privacy Policy.
  • Review and approval of message copy before a campaign goes out. Nothing sends without your sign-off.

8. Acceptable use

You may not use a system we build to send spam, to contact people who have not consented or who have opted out, to mislead anyone about who is contacting them, or for anything unlawful. If you do, we may suspend or terminate the service immediately. This is not negotiable — it protects your sending reputation as much as ours.

9. Ownership

  • Yours: your data, your customer lists, your content, your accounts, and your brand.
  • Yours on full payment: the custom configuration and workflows we build specifically for you.
  • Ours: our underlying tooling, templates, libraries, and general know-how, including anything we built before or independently of your project. We keep the right to reuse general techniques and improvements.

10. Third-party services

Your system depends on services we do not control — telephony, email delivery, your CRM, payment processors, calendars, and AI model providers. We choose reliable ones and monitor them, but outages, pricing changes, and policy changes at those providers are outside our control and are not a breach of these terms.

11. What we do not promise

We build systems designed to produce results, and we are careful about what we claim. We do not guarantee a specific number of bookings, leads, replies, reviews, or dollars of revenue. Any figures in examples on this site are illustrative of what these systems are designed to do, not a promise of your outcome. Automation reduces missed work; it does not eliminate every error, and AI systems can occasionally get something wrong. Services are provided on an "as is" and "as available" basis to the fullest extent the law allows.

12. Limitation of liability

To the extent permitted by law, AM Builder is not liable for indirect, incidental, special, or consequential damages, or for lost profits, lost revenue, or lost data. Our total liability for any claim relating to the services is limited to the fees you paid us in the three months before the claim arose. Nothing here limits liability that cannot be limited by law.

13. Confidentiality

We keep what you tell us about your business confidential, and we expect the same about how our systems work. We will not name you as a client publicly without your permission.

14. Suspension and termination

Either of us may end an engagement with reasonable notice. We may suspend service immediately for non-payment or for a breach of the acceptable use section. On termination we will, on request, hand back your data and help with a reasonable transition.

15. Changes to these terms

We may update these terms. The version on this page at the time you engage us is the one that applies, and we will tell active clients directly about significant changes.

16. Governing law

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. The courts of Alberta have jurisdiction over any dispute, and we both agree to try to sort it out directly first.
